General Terms and Conditions

1. Scope of Application

 

These General Terms and Conditions (hereinafter referred to as “GTC”) apply in their current version to all contracts concluded between the contracting party (hereinafter “Customer”) and Apex Adventure (hereinafter “Provider”) regarding participation in canyoning and rafting tours.

These GTC shall apply exclusively. Conflicting or deviating terms and conditions of the Customer shall not be recognized unless the Provider has expressly agreed to their validity in writing. The valid version of the GTC is the one in force at the time of the Customer’s inquiry or booking.

2. Booking and Conclusion of Contract

Tour bookings can be made by email or via the booking form on the Provider’s website. A booking represents a binding offer by the Customer to enter into a contract. The contract is concluded through written confirmation by the Provider or through the actual execution of the tour.

The Provider reserves the right to reject a booking without giving reasons. The Customer is obligated to provide truthful and complete information when booking. The Customer agrees to pay the agreed price for the tour.

3. Scope of Services and Prices

The scope of services is based on the respective tour description and any agreed additional services. The prices are published on the Provider’s website or in the current price list. All prices include VAT and other applicable duties under Austrian law.

Unless otherwise agreed, payment is made on-site on the day of the tour. The Provider may require a deposit to confirm the booking.

4. Cancellation Rights and Conditions

 

The Customer may cancel or withdraw from the contract at any time. Cancellations must be submitted in writing or by email.

Cancellation fees:

  • up to 48 hours before the start of the tour: no cancellation fee

  • Up to 24 hours before the start of the tour: 50% of the total price

  • Less than 24 hours before the tour or no-show: 100% of the total price

The decisive factor for meeting the cancellation deadline is the receipt of the withdrawal notice by the Provider. Errors in transmission or similar are the responsibility of the Customer.

If the Customer is under the influence of alcohol, drugs, or medication that could compromise safety, or if they persistently refuse to follow guide instructions, the Provider reserves the right to cancel participation at any time. In this case, the Customer is not entitled to any refund and is required to pay the full amount.

5. Disclaimer of Liability

The Provider is not liable for injuries or damages caused by improper conduct or failure to follow safety instructions. The Customer is responsible for their own actions during the tour and for any damages they may cause.

6. Changes to the Tour

The Provider reserves the right to modify the tour due to weather conditions or for safety reasons. In such cases, the Provider will offer alternative tours or reschedule the tour date.

Force majeure events (e.g., epidemics, pandemics, official closures) and other unforeseeable circumstances beyond the Provider’s control release the Provider from their service obligations.

7. Data Protection

 

The Provider collects and processes personal data exclusively in accordance with legal requirements and for the purpose of fulfilling the contract. Detailed information is available in the Provider’s privacy policy, which is accessible on the website.

8. Final Provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. In such cases, a replacement provision shall apply that most closely reflects the intended commercial purpose.

Austrian law applies. The place of jurisdiction is the registered office of the Provider.
